2.1 Scope of Services

CA Process Servers provides professional legal document service and process serving solutions in compliance with California law. Our services include:

• Service of summons, complaints, and other legal documents

• Substituted service and alternative service methods

• Affidavits of service and proof of service documentation

• Nationwide service coordination

• Skip tracing and location services

• Courier and delivery services for legal documents

2.2 Service Limitations

We do not provide legal advice. We are not your attorney. If you require legal counsel, please consult with a licensed California attorney. Our role is limited to delivering documents in accordance with applicable rules of court and statutory requirements.

2.3 Best Efforts

While we make best efforts to locate defendants and serve documents timely, we cannot guarantee service will be successful. Some individuals may be difficult to locate or unavailable for service. We will provide affidavits documenting our service attempts.

3. Engagement and Service Requests

3.1 Service Request Procedures

To request our services, you must:

• Provide complete and accurate information about the intended recipient

• Provide legible copies of all documents to be served

• Specify the type of service required (personal service, substituted service, etc.)

• Provide payment information and authorize charges

• Authorize us to attempt service in accordance with applicable law

3.2 Authorization

By submitting a service request, you:

• Authorize CA Process Servers to attempt service of the documents provided

• Warrant that you have authority to authorize service

• Represent that the service is lawful and not for harassment or unlawful purposes

• Authorize us to contact the intended recipient and relevant parties as necessary

• Agree to indemnify us for unlawful service requests

3.3 Document Requirements

You must ensure that:

• All documents are legible and complete

• Documents are authentic and properly executed

• Documents comply with applicable court rules and formatting requirements

• You have obtained all necessary court approvals before requesting service

CA Process Servers reserves the right to refuse service of documents that appear unlawful, improperly executed, or that we reasonably believe violate these Terms.

4. Fees and Payment Terms

4.1 Service Fees

Our service fees are established based on service type, location, and complexity. A detailed fee schedule is provided upon request and will be confirmed in writing before service is initiated.

Standard fees include:

• Service of process fees

• Mileage and travel charges

• Skip tracing fees (if applicable)

• Affidavit preparation and filing

• Rush service fees (if applicable)

• After-hours or weekend service fees (if applicable)

4.2 Payment Terms

Payment is due:

• Upon service completion (standard terms)

• In advance for rush or specialized services

• As otherwise agreed in writing

We accept payments via:

• Credit card

• Debit card

• Bank transfer

• Check (with prior arrangement)

4.3 Late Payment and Collections

Invoices are due within 30 days of service completion. Accounts past due by 30 days or more may be subject to:

• A monthly late fee of 1.5% of the outstanding balance (not to exceed legal limits)

• Suspension of future services

• Collection proceedings

• Attorney's fees and court costs

4.4 Refunds and Cancellations

• Failed service attempts: Applicable fees remain due for time and expenses incurred

Cancellations before service: Subject to cancellation fees as published in our fee schedule

• Service retraction: If you request service retraction after a service attempt, applicable fees remain due

No refunds are issued for completed service or good-faith service attempts.

5. Liability and Limitations

5.1 Disclaimer of Warranties

CA Process Servers provides services "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We make no warranties regarding:

• Accuracy or completeness of information

• Non-infringement of third-party rights

• Merchant quality or fitness for a particular purpose

• Error-free operation or uninterrupted service

5.2 Limitation of Liability

To the maximum extent permitted by law, CA Process Servers shall not be liable for:

• Indirect, incidental, consequential, or punitive damages

• Lost profits, lost data, or lost business opportunity

• Damages arising from service failure, delays, or errors

• Damages exceeding the total fees paid for the service in question

• Any damages arising from events beyond our reasonable control

5.3 Service Failures

While we maintain reasonable diligence in service attempts, we are not liable for:

• Inability to locate the intended recipient

• Service delays due to weather, traffic, or circumstances beyond our control

• Third-party interference or refusal to accept service

• Inaccurate information provided by you

• Court system delays or procedural requirements

5.4 Indemnification

You agree to indemnify, defend, and hold harmless CA Process Servers, its officers, employees, and agents from any claims, damages, liability, costs, and expenses (including attorney's fees) arising from:

• Your use of our services

• Any breach of these Terms

• Violation of applicable law in your service request

• Claims that served documents violate third-party rights

• Any damages related to unlawful service requests

6. Confidentiality and Data Protection

6.1 Confidential Information

We maintain the confidentiality of information you provide and protect it in accordance with our Privacy Policy. We will not disclose confidential information except:

• As necessary to perform our services

• To service providers under confidentiality obligations

• As required by law or court order

• With your written consent

6.2 Legal Compliance

We comply with California's data privacy laws, including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). Information collected is used solely for process serving purposes and service improvement.

7. Restrictions on Use of Services

11.2 Jurisdiction and Venue

You agree that any legal action or proceeding arising from these Terms or our services shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

11.3 Attorney's Fees

In any legal proceeding to enforce these Terms, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs.

12. Modifications and Termination

CA Process Servers reserves the right to modify these Terms at any time. Modifications become effective upon posting to our website with an updated "Last Updated" date. Your continued use of our services constitutes acceptance of modified Terms.

12.2 Termination of Services

CA Process Servers may terminate or suspend services to you if:

• You engage in unlawful or fraudulent conduct

• You violate applicable law

• We determine continued service would expose us to legal liability

Termination does not eliminate your obligation to pay outstanding fees.

13. Severability

14. Entire Agreement
